最近移民局的动作很大。有很多学生在机场的时候发现签证被取消了。然后必须得回国。今天就碰到一个客户这样子的情况。
到了机场，移民局interview 你，大概10分钟，然后就根据Mig.Act section 116 取消你的签证。这样的话，你是没有MRT review right 的。也不能申请cancellation revocation. 唯一一条路就是上Federal Court 打。这个花钱不是一点点的。
有些时候移民局做出签证取消的决定都是在下班时间。你能否找到lawyer 来接这个case 都是一个问题。
如果找到lawyer了，签署了授权书form 956, lawyer 立即开工，去FCC 申请habeas corpus ， judicial review and interlocutory injunction to restrain the Minister deporting the person. 赶紧打电话给法庭的duty Registrar 安排法官做一个urgent 的开庭。
就算你以上这些工作都做足了，联系移民局的律师安排延期驱逐，但是移民局的律师一般不会接受。
你需要在移民局驱逐你的客户前，拿到法院的interlocutory injunction 。
然后就是正常的FCC法律程序。
但是如果到了机场，签证是根据Mig. Act section 137 自动取消的，这种可以申请revocation。一般不需要花钱去FCC进入上面所说的冗长昂贵的法律程序。
综上所述，现在如果你签证有问题，请不要出境，或在回来前让移民局用s137 自动取消你的签证。联系你的移民代理做revocation.
一般来说即使签证取消被撤销了 （revoked ） 那么cancellation decision 仍然是有效的。下次申请签证的时候必须如实填写这次的取消历史。

s133(1) – The visa period
Section 133(1) provides that, if a visa cancellation is revoked, the visa has effect as if it were granted upon revocation. This means that the cancellation decision was not null and void from the time it was made. It has effect until it is revoked.
但是这点上学生签证很特殊
学生签证取消如果被revoked 了，那么就相当于从来没有取消过，不存在任何污点。
