The Family Law Reform Act 1995 (FLRA)
The FLRA replaced the concepts of custody, access and guardianship (which were used in the Regulations) with the broader concept of parental responsibility. This concept refers to “all the powers, duties, responsibilities and authority which, by law, parents have in relation to children”. 澳洲的家庭法在1995改革后已经没有监护人的概念，取而代之的是一个广义的父母责任。（parental responsibility ）定义为所有的父母应该享有的责任，义务，权力。
Access orders are unlikely to provide a person with rights to decide where a child can live. However, it is possible that some countries would not allow the person with custody to remove the child if another person has access to the child. Officers should satisfy themselves as to the relevance of access – bearing in mind that it is the right to decide where the child shall live that is the key issue – on a case by case basis.
