在原来的457签证废除后,澳大利亚政府出台了一个新的签证(temporary skill shortage visa)简称为TSS 482 visa.

TSS 482 签证包括2个子类别 1个是2年的 短期TSS类别和一个最长4年的中期TSS类别。

482工作签证的特点

对于提名公司来说

  1. 申请人的职位必须在STSOL或者MLTSSL清单上。https://immi.homeaffairs.gov.au/visas/working-in-australia/skill-occupation-list 。 short term skilled occupation list (STSOL) 每6个月更新一次,目前STSOL有400多个职业,59个职业受到严格限制。在这435个职业中 有24个职业也只是在指定地区可以申请。
      • 申请人可以持有此签证在澳洲工作一般是2年,香港护照持有人可以5年。职位必须真实 法律的如下判例说明,职位不仅要存在还必须是从事提名的工作内容。In Nguyen and Vu Publishers Pty Ltd v Minister for Immigration and Anor [2013] FCCA 1697, the Court held that the task for the Tribunal is to determine whether the nominated occupation corresponds to an occupation in the applicable instrument, and that such a judgment must inevitably compare the real duties of the nominated position with that of a specified occupation. In addition the recent decision of the Federal Circuit Court, Cargo First P/L v MIBP [2015] FCCA 2091, the Court said that what is required by r.2.72(f) is a determination of not only whether or not the position in question is genuine in that it exists, but also whether it really is what it purports to be. The second part of the determination necessarily requires a qualitative analysis of the position and its comparison with the occupation which has been nominated by the sponsor, not simply a determination whether the duties relevant to the position include the majority of those referred to in the ANZSCO description.
      • 只有在业务范围内的职位才是真实的.比如工厂提名一个焊工,餐馆提名一个厨师,建筑商提名一个建筑师等等,但是如果一杂货店提名一个会计,肯定有难度.移民局会要求提供公司结构图,对这个职位在公司里的作用的简介.原来在这个职位上的人员离职情况,现在申请人是否在这个职位工作了一段时间.公司是否有新的合同,现在雇员的overtime 情况.如果是因为公司扩展,业务范围扩大产生的职位,或者新公司的职位需要提供市场调查报告,公司扩展计划.预算.扩展资金是否到位. 一般来说这样的职位提名是属于移民局重点关注的领域.会审查的比较严格。比如一个杂货店的老板要开一家理发店, 或一个皮包it 咨询公司提名Analyst programmer他需要提供1 business plan and budget说明计划的可行性2 lease agreement 说明经营场所3 购买设备的合同. 包括购置剪刀,剪发座椅,美分设备的合同.4 扩展资金的到位情况.刚开业的公司也可以对应以上要求提供证据。

  3. 疫情期间劳动力市场测试

最新的 Legislative Instrument – F2020L01123 – LIN 20/156: Jobactive – Period, manner and evidence of labour market testing Amendment Instrument 2020.规定了劳动力市场测试的最新要求

    • 必须在Jobactive 网站上刊登招聘广告 并且
    • 必须至少在2个以下的媒体上刊登广告。
      • 有澳洲影响力的招聘网站 on a recruitment website with national reach in Australia; or
      • 有全澳影响力的纸媒 in print media with national reach in Australia; or
      • 有全澳影响力的广播电台 on radio with national reach in Australia; or
      • 如果担保人是金边担保人(accredited sponsor) 那么可以在担保人的网站上打广告 on the approved sponsor’s website.
        •  对于广告来说必须具备以下要件
          • 职位的名称和具体的职位描述
          • 胜任这个职位需要用到的技能和经验需求
          • 招聘雇主的名字,或者招聘雇主委托的招聘中介的名字
          • 如果招聘的职位收入低于$96,400,职位的薪水情况
          • 广告投放时间不得少于4个星期
    • 广告结束后需要提供一个雇主书面陈述,提供为什么找不到当地人的原因说明。
  1. 提名职业在STSOL清单上短期类别TSS 只能续签一次。
  2. 提名职业在MLTSSL清单上的中期类别的TSS 在3年后可以转PR
  3. Non-discriminatory workforce test 非歧视测试
  4. 更严格的公司培训要求,目前可以直接交到Skilling Australians Fund(SAF)。但是如果提名失败,这个培训费SAF移民局是不退的。
  5. 和ATO进行数据匹配,移民有专门部分人负责核查,确保 482持有人的工资是按时支付的。
  6. 申请人需要提供无犯罪记录证明
  7. 目前申请482英文要求是总分5, 每项不低于4.5。如果高收入申请人可以在482阶段申请英文豁免。
  8. 特定职业必须满足其职业的特定要求Caveat。
  9. 如果是Trust 性质的公司来做雇主担保,只有Trustee 可以作为提名公司。 Trusts By definition, a trust is a fiduciary obligation imposed on one person (called the trustee) to hold property for a particular purpose or on behalf of other persons (called beneficiaries). Under this relationship, the trustee is required to exercise certain rights and powers for the benefit of the beneficiaries. The terms of a trust arrangement are set out in a document called the “trust deed”. The trustee is compelled by law to deal with trust property in accordance with the terms of the trust. The operation of trusts is governed by State/Territory legislation. The main parties to a trust are: • settlor • appointor • trustee • beneficiaries. The settlor is the person who establishes the trust by “settling” a sum of money (“the settled sum”) and signing the trust deed. The settlor has no further role. The appointor is the person who may be named in the trust deed as the one with the power to appoint and remove the trustee. The trustee is the person who has the legal right and obligation to act on behalf of the beneficiaries in managing the affairs of the trust. The beneficiaries are the persons for whose benefit the trust arrangement has been set up. Most prospective sponsors using a trust structure operate as “family trusts”. In a family trust, the beneficiaries are members of a family (or extended family) and the trustee is usually a limited liability company in which one or more of the beneficiaries hold shares and are directors. The trust deed stipulates how income is to be distributed among beneficiaries. A unit trust is another trust structure commonly used in business. In a unit trust, property owned by the trust is divided into units that can be bought and sold as investments. The unit owners have an equitable interest in the property (unlike shareholders of a company, who do not have any direct interest in the property owned by the company). Income is distributed on the basis of units held. A trust is simply a relationship and not a person. Therefore, a trust cannot be an employer for the purposes of regulation 5.19. An application for approval of a nominated position would need to be made by the trustee or trustees, acting on behalf of the trust. For all practical purposes, if a business is operated under a trust arrangement, the trustee (acting on behalf of the trust) must be the nominating employer. The trustee may be an individual, a partnership or a limited liability company. Relevant legislation requires the financial affairs of the trust to be separated from those of the trustee. The trustee is required to: • file a separate tax return for the trust [the trustee (when acting in its capacity as trustee) will have an ABN • maintain a separate set of financial records covering the activities undertaken on behalf of the trust.

186签证的特点

  1. 更严格的英文要求 除非是DAMA项目的客户,都需要英文达到6666 才可以转PR。
  2. 申请人至少要有3年的工作经验。
  3. 申请必须在45岁以下
  4. 更严格的雇主培训要求
  5. 更严格的市场工资要求
  6. 186签证的相应职位移民局也期望可以在Jobactive 网站上优先找一下本地人,如果没有在jobactive 网站上尝试找当地人,移民局会以不满足Genuine need 的要求拒签。具体来说,对于186 DE签证来说是以5.19(9)(d) ,对于186 TRTS是以 5.19(5)(k)来拒提名的申请。

疫情期间的额外要求

受到疫情的影响,移民局和AAT对提名公司的财务能力尤其重视,需要提供有说服力的论证担保公司是有能力负担提名员工的工资并可以持续盈利运营的。
