2024年4月24日，澳洲移民局把新的485申请人年龄上限限制在35岁。 这个限制会影响除了香港护照持有人以外的所有申请人，在2024年7月1日开始执行。
如果你是35岁以上在澳洲读书，这个学期毕业的申请人，你该怎么办？ 有没有方案可以在没有完成信的情况下，提前递交这个485签证呢。志杰移民告诉你该如何在7月1日新政执行前，在没有完成信的情况下递交485。
一般来说485申请是需要申请人取得完成信的，并且需要485申请在取得完成信后至少后一天递交。 Mahohoma v Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs [2020] FCCA 2206 per Kendall J (at [51]). FCC 法官Kendall 指出如果签证申请和完成是同一天，是不能满足immidiately before 的要求的。
我不同意Kendall J 的意见， 因为根据FCA的法官Makerracher J 在Ali v Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs [2021] FCA 1311 (27 October 2021) 的意见 para 54
The approach that substance over form was intended. … Equally, it supports good administration in the sense that an applicant may seek a visa as soon as the applicant has effectively completed the degree. An applicant who move quickly rather than slowly is rewarded.
如果35岁以上，2024年7月完成课程的同学一般来说 6月27日可以看到所有成绩，但是完成信要等到7月14日左右才能发。 学校在出成绩之后，有一个复核 ratification的过程。 很多人认为必须这个复核的过程通过才算完成课程，比如FCC的法官 Cowdroy J， 在Sapkota v Minister for Immigration and Citizenship [2012] FCA 981 的判例 para 25 说 ：“the final piece of assessment has to meet the insititution’s requirements for progression through the course.”
但是FCA的法官Makerracher J 持有不同的观点， FCA是高于FCC的，所以目前common law 对于完成课程的司法解释要以 FCA的法官Makerracher J的意见为准。 Makerracher J 的意见是 the achievement of a satisfactory grade in the final unit 作为判断标准。
有的人可能会争论，考完试的成绩也可以被学校取消啊， 这个完成是provisional 的而不是确定的。在ALI的判例中，移民局持有相同的论点。 移民局的代理律师的意见是 This completion was only provisional and could be displaced by a board of examiners which was effectively a concession that completion did in fact occur at ratification. 法官Makerracher J 严厉的驳斥了这种观点。 para 52 他的意见是 “I consider this hypothetical analysis to be distraction”
在移民局PAM 签证审理操作手册中，对于完成时间也给出了以下多种选择，不单只有完成信一种可以用来证明完成的文件。
Evidence of this completion date could be notification of final exam results:
- in a letter to the applicant;
- on the internet;
- in a newspaper; or
- on the education institution’s bulletin board.
所以的判例法认定完成时间就是最好一个课出成绩的时间。如果你是35岁以上的客户，在最后一门课出成绩，或者还没有出成绩，但是老师已经内部批出了成绩并且在学校系统里面提交了，就可以根据FCA的法官Makerracher J在Ali v Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs [2021] FCA 1311 (27 October 2021)对于完成课程的理解，来递交485签证。
