目前澳洲商业移民BIIP项目已经全线叫停，先知先觉的有钱人已经来到了澳洲，后知后觉的人是不是就没有机会了呢？目前不需要英文的移民方案已经没有了，但是现在谋求移民澳洲的新一代企业家已经从60后，70后，逐渐向70后 80后转变。 70后，80后的申请人，是具备一定的英文基础的。那么有没有可能设计一条途径，作自雇人士利用482签证Temporary Skill Shortage (TSS) 项目然后接上Permanent Employer Sponsored Entry （PESE）项目移民呢？
482签证是为了解决澳洲雇主的短期用人需求设立的一类签证。 482签证系统一共有3个构成部分，Sponsorship, Nomination, 和 Visa application。
482雇主担保和其他类别的雇主一样的主要难点就是一个职位真实性的判断。具体来说，对482签证就是如何满足Reg 2.72(10)(a)的要求。 如果482签证的申请人是director 或者owner of the sponsoring business, 就很可能不批准。
根据移民局审理手册 PAM 4.4.7.4的指导。 The policy setting do not prevent individuals from sponsoring themselves (that is self-sponsorship)-however,in such cases there needs to be another reason for the position being created. It cannot just be to facilitate a long term stay in Australia and/or create a pathway to permanent migration. 注意移民局的用词是Just，意思是”仅仅”，如果你只是为了用这个签证长期住在澳洲，或者想创造一个移民路径，这个移民局是不鼓励的。但是移民局又说 ： “ such arrangements can be approved under policy if there will be a genuine economic benefit to Australia ( for example, an innovative IT entrepreneur intends to move their buiness to Australia) 所以这个签证鼓励海外生意转移到澳洲来发展。也就是说对于在中国的商业移民，移民局关上一扇门的同时，又给你打开一扇窗，鼓励你把对澳洲经济有利的生意转移来澳洲，并且为你移民澳洲打开了一条路径。
那么要想获得这个TSS 482 签证, 可以通过你在中国的公司来创建澳洲分公司，自己提名自己提名自己来 establishing the Australian business or be responsible for operations of the business.

我们知道Overseas business sponsor（OBS） 可以做为担保主体申请TSS 482签证，但是Overseas business sponsor 有一个显著的缺点是不能把雇员从TSS项目转到可以申请PR的PESE项目上。
移民局的PAM3.3.1.1 Actively and lawfully operating a business in Australia-TRT 是这么规定的
if an overseas business sponsor establishes a business operation in Australia and wants TSS visa holder to remain in Australia, the Australian business should apply to become a standard business sponsor and have a nomination approved to transfer the TSS visa holder to their business. The Australian business can then nominate the TSS visa holder under TRT stream. The Australian business would become the actively and lawfully operating employer and any contractual arrangements will be between the Australian business and the nominee. it is feasible that some corporate elements (e.g. payroll) remain within the ambit of the overseas parent company.
为了能接入PESE项目，申请人入境需要再一次成立澳洲分公司，如果成立了澳大利亚公司以后，澳大利亚的分公司可以再做一次TSS的雇主担保，把申请人的TSS482 关系转到新成立的澳大利亚公司上，用这个澳大利亚公司接力完成PESE的PR阶段。
更有利的规定是PAM3.4.8.2 Employment with the same employer is relevant to the assessment of the requirement to have worked in the same position。对于什么情况下可能认为482的雇员是在同一个雇主下工作的说明： The nominator was an overseas business sponsor (OBS) who has subsequently established an Australian entity and become an Australian business sponsor (ABS)， the nominee can still be considered to have remained with the “same employer”。这种OBS下的工作经验可以和ABS下的工作经验累计计算来接入PESE项目申请186签证。
那为什么一定要用海外公司OBS作为跳板，而不能直接成立澳洲公司进入ABS，然后转上PESE项目呢？
主要原因有2个，第一个原因，是关于职位真实性的问题。在PAM 4.4.7.4中有好几个地方都对这种直接搞ABS来做TSS482签证的做法很不利。比如
- The nominee is a relative or personal associate of an officer of the sponsoring business.
- The nominee is a director or owner of the sponsoring business.
- The nominee is currently in Australia and already working for the sponsor and the nominee’s immigration history in Australia suggests that their primary motive is to stay in Australia on any type of visa.
- The business has been in existence for a very short period of time (for example, the business was created in the last 3-6 months and appears to have just been “created” for the purpose of migration).
- The business has a relatively small turnover that could indicate that, at the nominated salary provided, it would be difficult to support the number of proposed employees at the business.
- The business does not employ any, or employs very few, Australian employees.
如果用OBS只有真实性的问题以下一点需要克服
- The sponsor is an overseas business that has been approved to establish a branch of the business in Australia and the positions nominated are not such that the nominee would be assisting in establishing the Australian business or be responsible for a substantial part of the operations of the business in Australia.
第二个原因是OBS的申请是可以用$96400的高薪豁免英文的。这对于英语还不大好的申请人无疑是一个缓冲。对于香港申请人，利用485转191的特别渠道，更加是一个重大利好。
综上所述，利用OBS转入ABS 接入PESE的计划是科学可行的。
