州担保申请的要求答疑汇总

1 申请人如果在境内，是否需要在那个州居住？

NSW https://www.nsw.gov.au/visas-and-migration/skilled-visas/common-questions-about-skilled-visas

需要190 申请人在NSW必须保持在NSW居住至少6个月。 （in NSW and have continuously resided in NSW for a minimum period of six months）

需要491申请人必须再NSW至少3个月 （You must be currently residing in NSW and have continuously resided in NSW for a minimum period of three months.）这里并不清楚，这个3个月是不是要在NSW的偏远地区。

NSW不考虑持有旅游签证的居住时间。

We do not consider any time spent in NSW on a tourist visa as you residing in NSW. As such, any time spent in NSW on a tourist visa cannot be counted toward the required residency timeframe.

 

VIC

需要申请人必须居住在VIC。必须提供VIC的租房合同和银行账单。没有具体的居住时间要求。

WA

需要以WA居民优先审理的申请人，必须在WA居住。必须提供WA的居住证明，比如租房合同，银行对账单，保险证明，驾照或者注册。

（Applicants receiving a prioritised invitation based on residing in Western Australia must be able to substantiate this claim by providing evidence such as a residential property lease agreement, bank or mortgage statement, insurance policies, registration or driver’s licence renewal notice）

但是如果不在WA，可以和其他海外申请人士同等待遇。

SA

要求申请人在南澳居住至少12个月。

Applicants living in Australian states and territories other than South Australia are not eligible under the South Australian Graduate, Skilled Employment in South Australia, or the Outer Regional Skilled Employment categories.

TAS

要求申请人至少在TAS居住6个月，如果你的职业是TOSOL清单上的职业

Your employment must be in an occupation listed on the Tasmanian Onshore Skilled Employment Occupation List (TOSOL) and meet any caveats listed for that occupation.

否则需要申请人在TAS至少居住15个月

You must have been working in Tasmania in a role closely related to your skills assessment for at least 15 months immediately prior to your application.

NT

申请人必须在NT，并且如果申请人是学生签证，必须完成NT的课程

• if you or any of your migrating dependants are currently living interstate, you will not be eligible for the Northern Territory (NT) nomination
• if you or any of your migrating dependants are currently on a student visa and have not completed studies in an NT institution, you will not be eligible for NT nomination

QLD

2 申请人如果已经获得了一次邀请 能否再申请州担保？

NSW

不行，但是NSW并没有说如果申请人获得了其他州的491，能不能申请190的问题。

Once you are nominated by NSW—which means your NSW application was approved and you were invited to apply for the visa by Home Affairs—you become ineligible to be nominated again for any skilled visa. This is because each nomination uses one of the limited places allocated to us by Home Affairs, and we cannot reassign it to someone else. These spots are highly limited and based on the state’s needs and demand, so it’s not feasible for us to allocate more than one to a single migrant.

VIC

一般不行， 但是如果你拿到了491的邀请，第二年还是有机会申请190的。

We do not provide renomination in the following instances:

You do not submit your visa application within 60 days.
Your EOI was incorrect when we nominated you, including points claimed by you or your agent.
If you have been nominated for any skilled visa (either subclass 190 or 491), you cannot be nominated again in the same program year

WA

Clients are eligible for one nomination from the South Australian Government. If you were nominated for a 491, you can apply for a 191 to the Department of Home Affairs once you meet criteria.

TAS

不可以

No, we do not offer multiple nominations. If you have a subclass 489 or 491 visa and wish to become a permanent resident, your options are through the subclass 887/191 visa pathways.

Every nomination place comes from the limited quota of nomination places allocated by the Department of Home Affairs, even if it is for the same person. A renomination will use up another place, even if you have not accepted your application to lodge a visa application.
You may wish to contact us if there has been an error made on your EOI, however:
while we endeavour to accommodate applicants with this, we are under no obligation to re-nominate
it is the responsibility of you and/or your agent to ensure all application details are true and correct prior to lodgement.

QLD

不可以

No. Migration Queensland will not re-nominate any applicants in the same program year. This also extends to errors with points – make sure that you review your Expression of Interest (EOI) thoroughly to ensure your points are correct when submitting your EOI.

If you have been nominated, applied for, or hold a Skilled Work Regional (Provisional) visa (subclass 491), Migration Queensland will not nominate you for the Skilled Nominated (Permanent) visa (subclass 190).

This restriction also applies to the Skilled Regional (Provisional) visa (subclass 489).

On your ROI form, you can only choose one visa subclass, which must match the visa subclass chosen on your EOI. It is acceptable to include multiple visa subclasses on your EOI.

3 对申请人是否有工作经验要求，需要什么样的工作经验？

NSW

没有具体的工作经验要求。州担保是根据申请人的综合分数来筛选。

VIC

申请人必须在给实体位于VIC的雇主工作。

For subclass 190 visa nomination, if you are onshore, you must be living in Victoria. If you have claimed earnings from your employment in your Registration of Interest (ROI), your employer must be physically located in Victoria. Onshore applicants for subclass 491 visa nomination must be living and working in skilled employment in regional Victoria.

申请人不一定要在提名职业工作，但是申请190的申请人，工作必须在ANZSCO 1-3的skill level 的职业上

申请491的话，并没有要求一定做什么职业。维州的毕业生可以豁免工作经验要求。

If you are onshore and applying for subclass 190 visa nomination, you must be currently living in Victoria. Any earnings you are claiming must be from skilled employment in Victoria. Skilled employment includes any role that is at skill levels 1, 2 or 3 in the relevant ANZSCO classification.

If you are onshore and applying for subclass 491 visa nomination, you must be living and working in skilled employment in regional Victoria.

Recent Victorian Graduate

Recent Victorian graduates are exempt from the regional employment requirement. Only you are working in skilled employment can claim annual earning in your ROI.

WA

对于在WASMOL的schedule 1的职业邀请至少1年的澳洲或者海外工作经验，对于申请190的申请人还需要6个月的工作合同，对于491的申请人不需要，对于WASMOL的schedule 2 的申请人不需要工作经验但是对于190签证的申请人需要有6个月的工作合同 (You will need a contract of full time employment in Western Australia with a minimum of six months remaining on your contract at the time you apply for State nomination.)，对于491的申请人不需要工作合同，WA毕业生不需要工作经验，也不需要工作合同。

SA

工作经验必须每周超过30小时， 雇主必须在南澳有实体才行。连续6个月或者12个月的工作经验，如果工作中间有不超过1个月的gap, 可以考虑通融。

Your employer must have a physical presence in South Australia. Working for an interstate employer is not regarded as eligible work experience to meet the work experience requirements.

TAS

如果TAS的职业是必须提名职业相关，那么需要ANZSCO 前4位一致。

• For employment to be related to your skills assessment, the role must be consistent with ANZSCO Skill Levels 1-3 and be in the same four-digit group as the skills assessment. A candidate with a skills assessment for Analyst Programmer (261311) could work in any of the occupations included the 2613 Software and Applications Programmers group, such as Cyber Security Engineer (261315) or Software Engineer (261313)

如果tas的职业上的要求是in the same industry, 那么需要ANZSIC上的职业相关就可以。

QLD

工作必须在ANZSCO 的skill level 1的职业上

Under Queensland Graduates pathway, You are eligible to apply under this pathway if you meet the minimum work experience requirement and you:

• Have a bachelor’s degree or higher qualification from a Queensland university. Note, a Graduate Certificate or Graduate Diploma do not satisfy the eligibility criteria.

• This qualification must be in a priority field.

• Have completed 100 per cent of this qualification in Queensland.

• Have graduated after 1 July 2022.

You are eligible to apply under this pathway if you meet the minimum work experience requirement and you:

• Have a bachelor’s degree or higher qualification from a Queensland university. Note, a Graduate Certificate or Graduate Diploma do not satisfy the eligibility criteria.

• This qualification must be in a priority field.

• Have completed 100 per cent of this qualification in Queensland.

• Have graduated after 1 July 2022.

4 各个州都有什么target sector 

NSW : Health, Education, ICT,Infrastructure,Agriculture, Advanced Manufacturing, renewables, Care Economy,

VIC： Health, social service, education (including early childhood) , Construction, New energy, Digital economy-for the 491 visa, Advanced manufacturing- for the 491 visa, Hospitality and tourism for the 491 visa.

WA: Building and construction sector, education sector,health and social assistance, hospitality,

TAS： 考虑到TAS单独给Health Sector Job offer 开了一个pathway申请190， 应该TAS 还是Health Sector 优先。

SA: 建筑行业优先

5 各个州选择发放邀请遵循什么规则？

NSW

Target sector 优先，非target sector 的职业会按照EOI的分数高低来进行筛选。

High-ranking EOIs in occupations outside of the NSW target sectors may be considered during invitation rounds; however, it’s crucial to understand that the odds of receiving an invitation are exceptionally low due to high demand and limited spots. Therefore, we strongly recommend exploring all other migration pathways and not relying solely on a potential invitation from NSW

VIC

Target sector 优先， earning 也是一个很重要的筛选因素。30%的配额给海外。

There is no minimum earnings requirement to be eligible for Victorian visa nomination. Earnings are just one of many factors used to select Registration of Interests (ROIs) for invitation.

考虑 Age , English, years of experience, occupation skill level, education level , partner’s skill, Annual earning.  不考虑NAATI， PY 加分。所以申请VIC 搞NAATI PY 没有什么作用。

 

WA

人在西澳的特定行业特定职业的申请人优先。prioritised invitations for candidates with an occupation in a WA industry sector with critical demand for skilled workers

SA

特定行业的特定工作优先。

We will prioritise applicants who demonstrate a strong employment outcome （工作经验年数） and support critical sectors for nomination for the Skilled Nominated (Permanent) visa (subclass 190).

南澳洲不会选递交多个EOI的人

Candidates who are found to be submitting numerous EOIs may not be selected for SA nomination. If you have skills assessment for more than one occupation, it is recommended that your EOI reflect the occupation that aligns closer with your work experience and ensure you have sufficient work experience in that field to meet the requirement for state nomination.

South Australia will be assessing candidates on merit by the following factors:

1. English language ability
2. Years and field of skilled employment
3. EOI points

NSW

你可以再次申请，但是需要提供一个新的EOI

Yes, you can still be considered for NSW nomination in the future, even if your previous application was refused.

Important: If NSW has refused your application following an invitation to apply, you must submit a new EOI in SkillSelect to be considered in future invitation rounds.

VIC

如果州担保被拒，6个月内不得重复申请

If your application is refused, you will not be able to submit a new application for 6 months. This ensures our resources are allocated to processing applications that meet the requirements of the visa

WA

Migration Queensland will not re-nominate any applicants in the same program year. This also extends to errors with points – make sure that you review your Expression of Interest (EOI) thoroughly to ensure your points are correct when submitting your EOI.

Can I lodge another application for nomination if my previous application was not successful?

Yes, however a new application is highly unlikely to be successful unless your circumstances have changed and new information is available. For example, you have received a job offer or a new English test result.

Application fee AU$300 (plus GST where applicable) will be charged for each new application.

7 我可以claim 在职业评估结果规定的deemed skilled date 之前的工作经验么？

8 州担保接受自雇的工作么？

VIC

并没有说自雇不行，VIC主要是看收入的多少，自雇是和annual earnings estimation 相关的

Can I claim earnings as an independent contractor?

We may accept earnings from your employment as a contract worker or independent contractor in skilled employment. If you are invited to apply for nomination, you must support all your claims of earnings with documents in your application, including:

tax invoices,
contractor/services agreement,
your most recent Notice of Assessment,
your most recent income tax return.
We may request further information during the assessment of your application.

WA

WA 只有190签证需要提供工作合同，WA是不接受自雇的： Employment contracts submitted by an Independent contractor or those which demonstrate self employment do not meet the above requirements and are not suitable to be submitted when applying for WA State nomination.

SA

The business you work for must have an office in Queensland. A virtual office will not be accepted.

This applies to candidates under the Queensland Graduates and Skilled workers in Queensland pathways.

Working from home full-time is not allowed. You must be working at your employer’s business location. If you are applying for subclass 491 your employer must have an established office location in a designated regional area. Occasional work from home days are allowed.

Casual employment is not considered to meet Queensland’s minimum work experience requirements.

10  海外申请人有希望获邀么。

NSW

可以申请491 pathway 2 invited by NSW stream, priority occupations per the regional NSW skills list

VIC

对于healthcare, social service 和 teaching 的职业，491比较容易获邀。总配额的30%给海外申请人。

If you are offshore and applying for subclass 491 nomination, we are currently prioritising candidates with skills in healthcare, social services and teaching.

WA

对于境内其他州的申请人和境外的申请人一视同仁。

• equal invitation ranking for Interstate and Overseas candidates;

TAS

海外人士申请190只有通过overseas applicant (Health Sector Job offer) pathway,申请491只能通过overseas applicant job offer pathway 或者 invitation only pathway.

SA

海外人士需要有工作经验才行。

For most occupations, applicants must have a minimum of three years of skilled employment in their nominated or related occupation within the last 5 years to secure an invitation to apply for SA nomination

For occupations in the construction trades (as listed below) applicants must have a minimum of one year of skilled employment in their nominated or related occupation within the last 3 years.

11 如果我有紧急情况，我的申请可以加急么？

SA

州政府会考虑一些紧急情况比如年龄到45，签证到期等，但是不保证什么结果。

We are not able to provide priority processing for registrations of interest however we will endeavour to monitor applications with a pending visa expiry.

Skilled and Business Migration cannot guarantee an outcome prior to the required date, and you are encouraged to explore other visa options.

As the allocation for nomination places is limited, South Australia will consider a range of factors when determining who is invited to apply. Please note that submitting your registration of interest does not guarantee an invitation to apply for state nomination even if the published requirements are met.

If you are working in South Australia and you will turn 45 years of age before you can satisfy the minimum work experience requirements, we may still apply for state nomination and send an online enquiry to request priority processing.

Please provide a statement outlining your situation for consideration during assessment. This does not guarantee nomination, each application is assessed on a case-by-case basis

TAS 没有加急通道

If your visa is about to expire and you may be at risk of becoming unlawful in Australia, please contact the Department of Home Affairs and/or a registered migration agent as soon as possible to resolve any potential issues with your immigration status.

QLD 能源行业可以加急

If you have an eligible occupation for priority processing on the offshore QSOL, you must be able to demonstrate that you have at least three years of relevant skilled employment in the energy sector. This can include working on energy projects.

In particular, experience related to the development, construction or operation and maintenance of projects such as solar farms, wind farms, hydro-electric power plants / pumped hydro projects, high voltage transmission lines, large-scale battery storage, battery manufacturing and hydrogen production plants will be highly valued.

NT

How does the NT Government prioritise nomination applications?

MigrationNT generally assesses applications in order of receipt. Priority processing may be afforded where:

• an applicant is living in the NT and has an imminent visa expiry date within the next 30 days
• an applicant turns 45 within the next 30 days, or
• an applicant will lose migration points (due to change in age) to below 65 points within the next 30 days, making them ineligible for a subclass 491 nomination.

If any of the above deadlines apply, please email migration@nt.gov.au with evidence of the urgency.

12 如果我在雇主担保签证上，是否需要雇主的同意？

SA 如果你的签证长度超过12个月你是需要雇主同意的，如果没办法取得雇主同意，南澳洲政府会酌情考虑。

Yes, you can, however, if you have more than 12 months remaining on your visa, you must provide a letter from your current employer consenting to state nomination application. If you are unable to provide a letter of support the application will be considered on a case-by-case basis.

13 我的雇主需要在所在州有办公室么？

SA 是的。

Your employer must have a physical presence in South Australia.  Working for an interstate employer is not regarded as eligible work experience to meet the work experience requirements.

14 ROI 递交后什么情况下需要更改

SA 只有在更换工作之类的重大变化才需更改，更改的办法是withdraw 原来的ROI并且递交一个新的ROI 。

15 我可以递交多个ROI么？

SA 不可以。

You may only have one Registration of Interest (ROI) submitted at any time. This supports the integrity of our invitation process, making sure we are inviting eligible candidates to apply for nomination. Candidates who have submitted numerous ROIs may be prevented from being invited to applying for nomination.

Candidates who are found to be submitting numerous EOIs may not be selected for South Australian nomination.

If you have skills assessments for more than one occupation, it is recommended that your EOI reflect the occupation that aligns closer with your work experience and ensure you have sufficient work experience in that field to meet the requirements for state nomination.

If you wish to show interest for both subclass 491 and 190, you can select both on the same EOI.
